Lithuanian Health Requirements

Lithuanian law No V-1123/A1-429 dated 2022 prevents adoption by persons with the following conditions:

On the approval of the list of diseases that a person suffering from cannot be an adoptive parent and/or cannot be appointed as a guardian (caregiver) of a child-

 1. Organic and symptomatic mental disorders:

1.1. dementias of all etiologies F00–F03, F09;

1.2. F04.0–F04.9, F05.0–F05.9, F06.0–F06.9, F07.0–F07.9 – except in cases where remission has lasted more than 5 years since the end of treatment.

2. Mental and behavioral disorders due to the use of psychoactive or volatile substances, several types of drugs:

2.1. F10.4–F10.9, F11.4–F11.9, F12.4–F12.9, F13.4–F13.9, F14.4–F14.9, F15.4–F15.9, F16.4–F16.9, F18.4–F18.9, F19.4–F19.9;

2.2. F10.0–F10.3, F11.0–F11.3, F12.0–F12.3, F13.0–F13.3, F14.0–F14.3, F15.0–F15.3, F16.0–F16.3, F18.0–F18.3, F19.0–F19.3 – except in cases where remission has been in place for more than 5 years since the end of treatment.

3. Schizophrenia group disorders:

3.1. F20.0–F22.9, F24–F29;

3.2. F23.0–F23.9 – except in cases where remission has lasted more than 5 years since the end of treatment.

4. Mood (affective) disorders:

4.1. F30.0 – except in cases where remission has lasted more than 5 years since the end of treatment;

4.2. F30.1, F30.2, F30.8, F30.9, F31.0–F31.9;

4.3. F32.0–F32.1, F32.8, F32.9 – as long as this disorder persists;

4.4. F32.2 – except in cases where remission has lasted more than 3 years since the end of treatment, F32.3 – except in cases where remission has lasted more than 5 years since the end of treatment;

4.5. F33.0–F33.2, F33.4–F33.9, F34.0–F34.9, F38.0–F38.8, F39 – except in cases where remission has lasted more than 3 years since the end of treatment;

4.6. F33.3.

5. Neurotic, stress and somatoform disorders:

5.1. F40.0–F40.1, F41.0–F41.9, F42.0–F42.9, F43.0, F43.2–F43.9 – as long as this disorder continues, except in cases where a consultative commission of doctors and psychiatrists, having assessed the severity of symptoms and social adaptation, concludes that the mental health disorders diagnosed with the person do not affect the person's ability to become an adoptive parent or guardian (caregiver);

5.2. F43.1, F44.0–F44.9, F45.0–F45.9, F48.0–F48.9 – as long as this disorder continues.

6. Behavioural syndromes associated with physiological disorders and somatic factors:

6.1. F52.7, F52.8, F52.9;

6.2. F53.0–F53.9, F54, F55.0–F55.9, F59 – as long as this disorder persists.

7. Personality and behavioral disorders in adults:

7.1. F60.0–F60.9, F61, F68.0–F68.8 – as long as this disorder persists, except in cases where a consultative commission of doctors and psychiatrists, having assessed the severity of symptoms and social adaptation, concludes that the mental health disorders diagnosed in the person do not affect the person’s ability to become an adoptive parent or guardian (caregiver);

7.2. F62.0–F62.9, F63.0–F63.9, F64.0–F64.9, F65.0–F65.9, F66.0–F66.9, F69.

8. Mental retardation, F70.0–F79.9.

9. Psychological developmental disorders:

9.1. F84.0–F84.4, F84.8, F84.9;

9.2. F84.5 – as long as this disorder persists, except in cases where a consultative commission of doctors and psychiatrists, having assessed the severity of symptoms and social adaptation, concludes that the mental health disorders diagnosed with the person do not affect the person’s ability to become an adoptive parent or guardian (caregiver).

10. Unspecified mental disorder F99.

11. Respiratory tuberculosis, confirmed bacteriologically and histologically, A15.

12. Chronic renal failure, N18, when dialysis is required.

13. Huntington’s disease, G10.

14. Hereditary ataxia, G11.

15. Lateral sclerosis, G12.2.

16. Parkinson's disease, stage IV, G20.

17. Alzheimer's and other neurodegenerative diseases, G30–G31.

18. Multiple sclerosis, G35, with an Expanded Disability Status Scale (EDSS) score of 7 or more.

19. Multisystem degeneration, G90.3.

20. Malignant neoplasms:

20.1. C00–C75 Stage I, unless the treating physician concludes that there is no progression of the disease 5 years after the end of active treatment;

20.2. C00–C75 Stage II, unless the treating physician concludes that there is no progression of the disease 5 years after the end of active treatment;

20.3. C00–C75 Stage III, IV;

20.4. C76–C80 Unspecified localization;

20.5. C81–C96, except in cases where, 5 years after the end of active treatment, the treating physician conclud
